　　冯先生向法院起诉称，今年1月28日21时左右，他从地铁八通线中国传媒大学站出站，通过手机扫码租用了拜克洛克公司投放运营的ofo共享单车。在骑行不到100 米处遇到下坡，结果自行车刹车突然失灵，导致他连人带车失控摔倒。

　　据冯先生回忆，当时其面部着地，牙齿当场折断5颗、缺损1颗，唇部、面部均受伤严重，经诊断为上下唇内外及面部挫裂伤，鼻梁骨折。冯先生认为，拜克洛克公司投放的产品应经国家有关部门许可，应保证产品不存在质量缺陷和安全隐患，运营过程中亦应做好维护保养检修工作，保障使用者人身安全。为此，冯先生将拜克洛克公司诉至法院，要求该公司赔偿医疗费、误工费、伤残赔偿金、后续治疗费、交通费、精神损害抚慰金等共2万元。

　　12月6日，澎湃新闻记者从上海市闵行区人民法院获悉，该法院对闵行区首起摩拜单车失窃案作出一审判决，判处韩某拘役三个月，缓刑三个月，并处罚金人民币1000元。

　　据法院介绍，中年男子韩某现年50多岁，他从江苏扬州农村来上海打工。经过多日观察，韩某发现自己租住房屋小区的门口，有一辆摩拜单车多日无人问津，遂于2016年9月14日夜里11点多，将该单车搬回自己的住处。

　　四天后，该单车所属公司员工通过装在摩拜单车上的定位装置进行精确定位，并按照定位的地址找到了韩某家，大门紧闭，该公司员工选择报警。

　　到案后，韩某表示，他认为涉案单车外观大气，颜色美观，比较高大上，便动了将该单车据为己有的念头。他不知道的是涉案单车价值1800元。法院审理后认为，韩某以非法占有为目的，秘密窃取公私财物，数额较大，其行为已构成盗窃罪，依法应予惩处。但其有坦白情节，可以从轻处罚，据此，法院做出了如上判决。
