论民事执行权的性质
摘 要
民事执行权的性质，主要是指该权力的国家分权属性，即在国家的基本权力类型中，民事执行权所属的类别，其在实践中表现为司法性和行政性的双重特征。分析民事执行权的性质，对于完善民事执行理论，合理设置民事执行机关、科学规范民事执行程序、保障司法公正具有重要的指导意义。

ABSTRACT
