审前准备程序初探
摘 要
审前准备是审判程序中的1个相对独立的诉讼程序阶段，有其独立的价值。该程序阶段完结有其相应的诉讼法律后果，对后来的判决结果有重要影响，审前准备内含着整理案件争点、固定案件证据、保障开庭审判、提高庭审效率等功能，但从立法和司法的现状看来，该程序所存在的缺陷也是不容忽视的，因此应对审前准备程序给予特别关注，就与之相关的若干问题展开论述。

ABSTRACT
The civil pre-trial preparation procedure is a relative independent course in a unitary litigation. It has its own value and litigation results. The civil pre-trial preparation produce has the function of regulating disputation, fixing evidence, guaranteeing hearings and enhancing the efficiency of a case. But from the present situation of legislation and jurisdiction, it also has some flaw. So it is very important to pay close attention to the civil pre-trial preparation procedure and make expound of it.
