论国际法上的集体安全制度—以黎以冲突为视角
摘 要
最近爆发的黎巴嫩和以色列的冲突是2006年的国际时政热点。此热点蕴涵着1些集体安全问题。本文从介绍该热点开始，引出对集体安全法概念的介绍，提出了集体安全法的6点法律特征和3点法律作用。集体安全的立法分为联合国内集体安全的立法和联合国外集体安全的立法。在现实国际社会中，两者之间的关系不好处理。在执法方面，作者结合黎以冲突个案发现并论述集体安全法执法过程中存在的否决权问题、禁止使用武力或威胁的限度问题以及自卫的问题。针对这些问题，作者提出了对策。

ABSTRACT
The recent conflict erupted between Lebanon and Israel was hot spot for international current spot. This hot spot is containing some collective security questions. This article will start from the introduction of the hot spot, which will draw out to the concept explanation of Collective Security Law, and then put forward to six law characteristics and the three-point method law effect of the Collective Security Law. The Collective Security legislation is divided into in the United Nations the collective security legislation and the union overseas collective security legislation. In the reality of international society, the relations between both are hard to handle. In the law enforcement aspect, I take the conflict between Lebanon and Israel as a case and then discuss the problems of veto, the prohibition of use military force or threatening and self-defense during the process of enforcing the Collective Security Law. In view of these questions, the author proposed the countermeasures.
